Questions
How much long service leave do I get in WA?
8.667 weeks after 10 years’ continuous employment, then 4.333 weeks for each further 5 years.
Do I get paid out if I resign before 10 years?
Yes, from 7 years. Pro rata is paid if you resign, are made redundant, die or are dismissed for any reason other than serious misconduct. It counts years, months, weeks and days.
How is pro rata worked out after 10 years?
On completed years only, at 0.8667 weeks a year since your last full entitlement. If you’re dismissed for serious misconduct, only the last fully accrued entitlement that you haven’t taken is paid.
Does unpaid leave count?
No. Most unpaid leave, including unpaid parental leave, doesn’t count towards continuous employment. It doesn’t break it either, but pushes your accrual date out.
Does this Act apply to me?
The Act doesn’t apply if your award or agreement gives long service leave at least equivalent to it. Many construction workers are covered by a portable scheme instead. State and territory laws don’t apply where a federal pre-modern award has long service leave terms, and enterprise agreements made from 1 January 2010 can include their own. The Fair Work Ombudsman can confirm which applies.
