    Questions

How much long service leave do I get in SA?

13 weeks after 10 years’ continuous service, then 1.3 weeks for each completed year after that. Full-time, part-time and casual workers accrue at the same rate.

Do I get paid out if I leave after 7 years?

Yes, 1.3 weeks for each completed year, unless you’re dismissed for serious and wilful misconduct or you end the contract unlawfully, such as by not giving the required notice.

Can I take leave after 7 years?

Only if your employer agrees. You’re entitled to take leave from 10 years.

    Does unpaid leave count?

No. Leave without pay and parental leave don’t break service but don’t count, so you need to work the extra time. Sick leave, paid or unpaid, counts.

    What pay is used?

Your weekly rate when leave starts or the payment is due, excluding overtime, shift premiums and penalty rates. If you were hourly, casual, part-time or your hours varied in the last 3 years, it’s your average weekly hours over those 3 years × your current hourly rate.

Does this Act apply to me?

State and territory laws don’t apply where a federal pre-modern award has long service leave terms, and enterprise agreements made from 1 January 2010 can include their own. The Fair Work Ombudsman can confirm which applies.
