Questions
Do casual employees get annual leave?
No. Casual employees don’t get paid annual leave under the National Employment Standards.
Does annual leave build up during probation?
Yes. It accrues gradually from your first day, including probation, and unused leave rolls over from year to year.
Is leave loading paid when I leave?
Unused leave must be paid out at what you would have been paid if you took it. That includes leave loading if you would get it when taking leave.
Who gets 5 weeks?
Shiftworkers, as defined by their award or enterprise agreement. Award and agreement-free employees can qualify if they work continuous 24/7 shift rosters and regularly work Sundays and public holidays. Under the Nurses Award, everyone gets 5 weeks and shiftworkers get 6.
Do I get leave loading?
Only if your award, agreement or contract provides it. Choose one of the selected awards to apply its loading rule. Some awards pay the higher of 17.5% or the weekend and shift penalties you’d have received, compared over the whole period of leave.
Which awards are covered?
Selected awards only: General Retail Industry Award 2020; Hospitality Industry (General) Award 2020; Clerks—Private Sector Award 2020; Fast Food Industry Award 2020; Social, Community, Home Care and Disability Services Industry Award 2010; Nurses Award 2020; Health Professionals and Support Services Award 2020. Other awards, enterprise agreements and contracts can differ. Choose “Other, or not sure” and enter your loading if it applies.
Is loading paid on an above-award rate?
It depends on the award’s wording. The Retail, Clerks, Fast Food and Health Professionals awards calculate loading on the minimum award rate. The Hospitality Award pays it on the amount payable under the NES, which can include an above-award base rate.
Does unpaid leave count?
No. Annual leave doesn’t accrue during unpaid leave, or for periods of leave that were cashed out.
