Questions
When can I take long service leave in Queensland?
After 10 years’ continuous service you can take 8.6667 weeks. After a further 5 years you can take another 4.3333 weeks (13 weeks in total). From 15 years, leave can be taken as it accrues.
Do I get paid out before 10 years?
Not before 7 years. Between 7 and 10 years, only if your employment ends because of your death; you resign because of illness or a domestic or other pressing necessity; you’re dismissed because of illness, or for a reason other than your conduct, capacity or performance; you’re unfairly dismissed; or a fixed term ends when you reasonably expected to reach 10 years. From 10 years, all service is paid out for any reason.
Are casual and part-time employees covered?
Yes, with the same 10-year qualifying period. Business Queensland works out the leave in hours: total ordinary hours ÷ 52 × 8.6667 ÷ 10. Casuals are paid at the loaded casual rate. A casual’s continuous service may end if there’s a gap of more than 3 months between engagements.
Does this Act apply to me?
Queensland’s long service leave rules can apply to employees covered by the Fair Work Act. State and territory laws don’t apply where a federal pre-modern award has long service leave terms, and enterprise agreements made from 1 January 2010 can include their own. The Fair Work Ombudsman can confirm which applies.
What about portable long service leave?
QLeave runs Queensland’s portable long service leave schemes. They aren’t covered here.
