Questions
How much long service leave do I get in the NT?
1.3 weeks for each completed year of continuous service, from 10 years: 13 weeks at 10 years. After that, leave can be taken for each further 5 years. Part years don’t count.
Do I get paid out if I leave?
From 10 years, yes, for each completed year less leave already taken. Between 7 and 10 years, only if you’ve reached retirement age, your employer ends your employment other than for serious misconduct, you resign because of illness, incapacity or a domestic or other pressing necessity, or you die.
What if I’m dismissed for serious misconduct after 10 years?
You’re paid for completed blocks only: the first 10 years, then each completed 5 years.
Can I cash out my leave?
Not while you’re employed. The Act only allows payment in lieu when employment ends.
How is pay worked out if my hours changed?
Each completed year is paid at your current hourly rate × that year’s weekly hours × 1.3. Overtime, penalty rates and district, site and climatic allowances are excluded.
Does this Act apply to me?
NT Government and Australian Government employees, and construction workers under the NT Build portable scheme, aren’t covered. State and territory laws don’t apply where a federal pre-modern award has long service leave terms, and enterprise agreements made from 1 January 2010 can include their own. The Fair Work Ombudsman can confirm which applies.
