Questions
How much long service leave do I get in Tasmania?
8⅔ weeks after 10 years’ continuous employment, then 4⅓ weeks for each further 5 years. Mining employees have different rules, which aren’t covered here.
Do I get paid out before 10 years?
From 7 years, only if your employer ends your employment (other than for serious and wilful misconduct), you reach retirement age, your employment ends because of illness, you resign because of incapacity or a domestic or other pressing necessity, or you die. From 10 years, pro rata is paid on any termination.
What is retirement age?
The age set by your award or contract. Otherwise the Act sets 65 for men and 60 for women.
Are casual and part-time employees covered?
Yes. You’re treated as continuously employed if you regularly work 32 hours or more in each consecutive 4-week period. Casual pay is based on the average hours over the last 12 months (total hours ÷ 52).
Does this Act apply to me?
The Act doesn’t cover employees under federal awards or agreements with long service leave terms, construction workers (TasBuild), or government employees. State and territory laws don’t apply where a federal pre-modern award has long service leave terms, and enterprise agreements made from 1 January 2010 can include their own. The Fair Work Ombudsman can confirm which applies.
